1. Purpose and scope
These Terms of Service govern access to and use of the Educere website, learner accounts, one-to-one tutoring, group classes if offered, self-paced courses, learning materials, messages, booking tools, and related services. In these Terms, Educere, we, us, and our mean the education service presented on this website. You and your mean the person visiting the site, creating an account, purchasing a service, participating in learning, or acting as a parent or legal guardian for a learner.
These Terms form a contract between you and Educere when you create an account, book a session, buy a course, access paid content, or otherwise indicate acceptance. The Privacy Policy, Refund Policy, and Cancellation and Rescheduling Policy form part of this agreement. A course description, booking summary, checkout notice, or written service proposal may contain additional terms. If a specific written term conflicts with a general term here, the more specific term applies to that purchase, except where the law requires otherwise.
Please read these Terms before using a paid service. If you do not agree, do not create an account, submit payment, or use restricted content. You may browse public pages without accepting paid-service terms, but the acceptable-use and intellectual-property provisions still apply to public content.
2. Legal status and review notice
Educere publishes these Terms to make its operating rules clear while its final legal entity details and jurisdiction-specific review are being completed. The contact form is the official channel for contractual notices until a formal business address and dedicated legal email are published. No wording in these Terms removes a statutory guarantee, cooling-off right, privacy right, remedy, or other protection that applicable law does not permit a business to exclude.
If a mandatory law gives you greater protection than these Terms, that law prevails. If a provision is uncertain, it should be interpreted in a way that preserves lawful consumer rights and the educational purpose of the service. Publication of this operational draft does not represent certification by a lawyer or regulator.
3. Eligibility and authority
You may enter into a purchase only if you have legal capacity to make the agreement. A person who has not reached the age of legal majority where they live must have a parent or legal guardian create or approve the account, purchase the service, and supervise use as appropriate. A parent or guardian who creates an account or makes a purchase for a learner confirms that they have authority to act for that learner and accepts responsibility for payment, scheduling, communications, and compliance with these Terms.
Learners under 13 may not independently create an account or submit personal information. Their parent or guardian must provide necessary details and remain the primary account contact. Educere may request reasonable evidence of age, identity, or parental authority when needed for safety, payment verification, or legal compliance. We will not ask for more information than reasonably necessary for that purpose.
You must not use the service if applicable law prohibits you from receiving it, if your account was terminated for serious misuse, or if you are acting for someone without authority. Educere may refuse a registration that appears fraudulent, unsafe, technically abusive, or inconsistent with learner protection.
4. Description of services
Educere offers English learning services that may include live tutoring, exam preparation, workplace English, self-paced courses, downloadable resources, quizzes, feedback, messages, certificates, and scheduling support. The exact scope, duration, level, teacher, price, access period, prerequisites, and included materials are stated on the relevant service page or checkout summary.
Course listings and tutoring descriptions are invitations to purchase, not guarantees that every service will remain available. A booking is confirmed only when the site displays confirmation or Educere sends a confirmation message after any required payment. Adding a course to a cart, beginning checkout, or selecting a time does not reserve access unless the checkout states otherwise.
Some site sections may show demonstration content while the curriculum is being completed. Demonstration labels, sample prices, placeholder profiles, and preview lessons are not offers for sale. Educere will identify purchasable services and their final terms before accepting payment.
5. Educational nature and learner outcomes
Educere provides instruction, guided practice, feedback, and learning resources. Progress depends on many factors, including attendance, starting level, practice, effort, technology, language exposure, and the time available before an examination or professional event. Educere does not guarantee a particular examination grade, school admission, job, promotion, immigration result, language score, or level of fluency.
Feedback represents an educator's professional judgment at the time it is given. It is not an official examination result, psychological assessment, legal opinion, immigration service, or professional certification unless expressly stated. Learners should independently confirm official examination syllabuses, registration deadlines, permitted materials, and rules with the responsible examination body.
Certificates issued by Educere may confirm completion or participation. They do not represent an accredited qualification unless the course description clearly identifies the accrediting body and basis. A certificate may be withheld when required activities have not been completed, identity cannot reasonably be verified, or account activity indicates misuse.
6. Accounts and accurate information
You must provide accurate, current, and complete information when registering, purchasing, or booking. Keep your contact information and timezone current so confirmations and reminders reach you. Do not impersonate another person, create an account using another person's information without permission, or provide a false age to avoid safeguards.
Each learner should use one account unless Educere approves another arrangement. Accounts are personal and may not be sold, transferred, rented, or shared outside an authorised parent-learner relationship. You are responsible for safeguarding your password and devices. Notify Educere promptly through the Contact page if you suspect unauthorised access, an incorrect booking, or misuse of your account.
Educere may require a password reset, temporarily limit access, or verify account ownership if unusual activity creates a security concern. We will take proportionate steps and restore access when the concern is resolved. You remain responsible for activity authorised through your credentials, but this does not make you responsible for activity caused by Educere's own failure to use reasonable security.
7. Parent and guardian responsibilities
A parent or guardian purchasing for a minor is responsible for choosing an age-appropriate service, providing truthful learner information, helping the learner attend, maintaining a suitable learning environment, and reviewing relevant communications. For younger learners, an adult should be available at the beginning and end of a live session and reachable during it.
The parent or guardian should discuss online conduct, privacy, camera and microphone use, and emergency procedures with the learner. They should ensure the learner joins from an appropriate space and does not reveal unnecessary personal information. Educere may ask a parent to join or end a session if safety, identity, behaviour, or consent is uncertain.
A minor must not make an independent payment, agree to recording, change sensitive account information, or arrange private off-platform contact with an instructor. Parents and guardians should use official Educere channels for scheduling, payment, complaints, and important decisions.
8. Booking and scheduling
Live-session availability appears through Educere's booking system. The system stores scheduling records using Coordinated Universal Time, or UTC, and aims to display available times in the visitor's detected or selected local timezone. You must check the date, time, timezone, duration, and service before confirming. Device or browser timezone settings may affect display.
A confirmed session reserves the stated time. Changes are governed by the Cancellation and Rescheduling Policy. Unless the booking page states a different approved rule, a learner may cancel or reschedule without a late-change charge at least 24 hours before the scheduled start. The booking system's recorded timestamp determines whether the request met the deadline.
Reminders are a convenience and may be delayed by email providers, device settings, or third-party services. Failure to receive a reminder does not change the confirmed booking. You remain responsible for attending at the confirmed local time and checking the account or confirmation message when uncertain.
9. Prices, currency, and payment
Prices, currency, taxes, and included services are shown before payment. You authorise Educere and its payment service provider to charge the displayed total using the selected method. A payment is complete only after successful authorisation. Educere does not intentionally store full payment-card numbers or security codes when payment is processed by an external provider.
Your bank or payment provider may apply conversion, cross-border, or processing charges that Educere does not control. Unless the checkout expressly states otherwise, those external charges are your responsibility. If a price or checkout total is clearly erroneous, Educere may cancel the transaction and refund the amount paid rather than provide the service at the obvious error price.
You must use a payment method you are authorised to use. Fraudulent payments, unauthorised chargebacks, or attempts to bypass payment may lead to suspension while the matter is investigated. Contact Educere first when possible so billing errors can be reviewed, without giving up any lawful right to dispute a transaction through your provider.
10. Refunds and credits
Refund eligibility is governed by the Refund Policy, the service description, and mandatory law. As a general operational rule, timely tutoring cancellations may be refunded or credited, Educere-caused cancellations qualify for a full remedy, and eligible self-paced course purchases may be refunded within the stated review period if usage remains below the published threshold.
Credits have no cash value unless the Refund Policy or law requires a cash refund. A credit must be used by the stated expiry date, if any, and cannot be transferred without written approval. Promotional items, bonuses, and discounts are treated according to their published terms.
Educere may request information reasonably necessary to identify the transaction and understand the issue. Approval of one discretionary refund does not create an entitlement to future exceptions. Nothing here limits a remedy for a materially misdescribed, defective, inaccessible, or unlawfully supplied service.
11. Course access and licences
When you purchase a self-paced course, Educere grants the named learner a limited, personal, non-exclusive, non-transferable, revocable licence to access the course during the advertised access period. The licence is for learning use only. Ownership of the course, site, lesson design, videos, text, graphics, quizzes, and downloadable resources remains with Educere or the identified rights holder.
You may download or print resources only where a download or print function is provided or written permission is given. Permitted copies are for the learner's personal study. You may not reproduce a course for a class, upload materials to a shared drive, sell notes or files, publish answer keys, record videos, stream lessons to others, remove rights notices, or use content to train an artificial-intelligence system.
Access periods begin at the time stated in the course description, which may be purchase, enrolment, or cohort start. Educere may make reasonable updates to improve accuracy, accessibility, or security. A material reduction in paid content will be addressed under the Refund Policy or applicable law.
12. Live-session rules
Join live sessions using the approved link and a display name that allows the instructor to identify you. Test your internet, microphone, camera where required, and learning space in advance. Behave respectfully, follow reasonable teaching and safety instructions, and avoid interruptions that prevent effective instruction.
Do not record, photograph, livestream, transcribe, or use automated meeting assistants during a session unless everyone affected has received clear notice and given any legally required consent. Educere will not routinely record one-to-one sessions. If recording is proposed for a specific educational or safeguarding purpose, Educere will explain the purpose, access, retention, and choice before recording begins.
Educere may pause or end a session for harassment, threats, discriminatory conduct, sexual content, suspected exploitation, unauthorised participants, persistent disruption, safety risk, or serious privacy concerns. A session ended because of the learner's serious misconduct may be treated as delivered, subject to fairness and applicable law.
13. Acceptable use
You must use the website and services lawfully and in a way that respects learners, educators, staff, and third parties. You must not:
- harass, threaten, exploit, groom, discriminate against, or impersonate another person;
- upload malware, attempt unauthorised access, probe security, scrape restricted content, or disrupt the site;
- share account credentials, meeting links, private messages, personal data, or paid materials without authority;
- submit unlawful, defamatory, deceptive, infringing, sexually explicit, or dangerous content;
- use answers, feedback, or tools to commit academic dishonesty or violate examination rules;
- contact a minor privately outside approved channels or arrange an unapproved in-person meeting;
- use the service for commercial solicitation, spam, recruitment, or resale without permission; or
- circumvent enrolment limits, access controls, regional restrictions, or payment requirements.
Educere may investigate credible reports, preserve necessary records, restrict features, or suspend access while protecting affected people. Reports should be made through the Contact page and should include enough detail for a fair review.
14. Learner submissions and communications
You retain ownership of original work, messages, assignments, and other content you submit. You grant Educere a limited licence to host, copy, display, annotate, transmit, and otherwise process that content only as reasonably necessary to deliver instruction, provide feedback, operate the account, prevent misuse, and comply with law. This licence ends when the information is no longer needed, subject to lawful retention and backups.
You confirm that you have the right to submit the content and that doing so does not violate another person's privacy, confidentiality, or intellectual-property rights. Avoid including unnecessary sensitive information in assignments or messages. Educere may remove content that is unsafe, unlawful, irrelevant, or technically harmful.
Service communications may include confirmations, access notices, schedule changes, security alerts, receipts, policy updates, and responses to support requests. These are not marketing and may be necessary to provide the service. Marketing messages, if used, will include the choices required by applicable law.
15. Intellectual property and brand use
The Educere name, logo, site design, original curriculum, copy, graphics, videos, worksheets, and software components are protected by intellectual-property laws. Except for the learner licence expressly granted, no right or ownership is transferred to you.
You may link to public pages in a fair and lawful way that does not imply endorsement. You may not frame the site, use the Educere brand in advertising, register a confusing domain or account name, or create derivative commercial materials without written permission. Any permitted use must preserve attribution and rights notices.
If you believe site content infringes your rights, contact Educere with identification of the work, the material at issue, your authority, a good-faith explanation, and reliable contact details. Educere may remove or limit material while reviewing a sufficiently detailed notice.
16. Privacy, children, and safeguarding
Personal information is handled under the Privacy Policy. Educere aims to collect only information reasonably needed for learning, booking, payment administration, support, security, and legal obligations. Information about minors receives additional protection, and parents or guardians may exercise rights on a minor's behalf where applicable.
Privacy is not the same as secrecy from safeguarding action. If Educere reasonably believes a learner or another person faces abuse, exploitation, self-harm, violence, or another serious danger, it may preserve and disclose relevant information to a parent, guardian, emergency service, safeguarding authority, platform, or law-enforcement body when lawful and proportionate.
Learners should not use Educere for emergency assistance. If someone is in immediate danger, contact the emergency service available in the person's location. Educere cannot continuously monitor messages or guarantee immediate response.
17. Third-party services
Educere may rely on hosting, WordPress, learning-management, scheduling, video-conferencing, payment, email, analytics, security, and other service providers. These providers may have their own terms and privacy notices. Educere selects and configures providers for operational needs but does not control every interruption, device requirement, or independent action of a third party.
A third-party link is provided for convenience and does not automatically mean endorsement. Review the destination before submitting information. If a required provider materially changes or becomes unavailable, Educere may substitute a reasonably comparable service, provide alternative access, reschedule, or offer a remedy appropriate to the impact.
Where Educere determines the purpose and means of personal-data processing, it remains responsible for its obligations even when a service provider processes information on its behalf. The Privacy Policy explains the categories of recipients and safeguards.
18. Availability, maintenance, and changes
Educere aims to provide reliable access but does not promise uninterrupted operation. Maintenance, updates, internet failures, security events, provider outages, device incompatibility, or events outside reasonable control may interrupt access. We will take reasonable steps to restore material functions and communicate significant scheduled disruption when practical.
Educere may improve, replace, or retire features. Changes will not intentionally remove the essential value of a paid service without an appropriate alternative, extension, credit, refund, or other lawful remedy. Minor interface, curriculum, or technical changes that preserve the educational purpose do not create an automatic refund right.
You are responsible for a compatible device, supported browser, stable connection, and any ordinary internet charges. Accessibility concerns should be reported so Educere can consider a reasonable alternative or adjustment.
19. Suspension and termination
You may stop using the service at any time. Account deletion requests are handled under the Privacy Policy, but deletion does not automatically cancel a confirmed session, erase a payment obligation, or remove records that must lawfully be retained.
Educere may warn, restrict, suspend, or terminate access for material breach, non-payment, fraud, danger, repeated disruption, unlawful conduct, intellectual-property abuse, or security risk. Except in urgent safety or security situations, Educere will usually explain the concern and provide a reasonable opportunity to respond or correct it.
On termination, the right to use restricted content ends. Provisions concerning payment, ownership, confidentiality, lawful retention, liability, disputes, and any terms that by nature should continue will survive. Where Educere terminates without learner fault, it will provide a fair remedy for unused paid services.
20. Complaints and dispute resolution
Contact Educere promptly if a service, charge, booking, safety decision, or account action appears incorrect. Describe the issue, relevant date, transaction or booking reference, desired resolution, and any supporting evidence. Educere will acknowledge and review complaints within a reasonable period, prioritising safety, access, and time-sensitive booking issues.
Both parties should first try to resolve a dispute through good-faith written communication. This informal step does not prevent either party from seeking urgent protection, using a payment-provider process, contacting a consumer or privacy regulator, or exercising a right that cannot be delayed or waived.
The governing law and forum will be those validly applicable to Educere's final operating entity and the transaction, subject always to mandatory consumer protections that apply where the customer lives. A future update will identify the operating entity and primary jurisdiction after legal review. Until then, these Terms should not be read as requiring a consumer to surrender access to a competent regulator or court.
21. Disclaimers and responsibility
Educere will provide services with reasonable care and skill. To the maximum extent permitted by law, public information and non-paid resources are provided as available, and Educere does not promise that every page will be error-free or suitable for every purpose. Nothing excludes an express promise made in a confirmed service description.
You are responsible for decisions you make using educational information and for verifying requirements issued by schools, employers, examination bodies, immigration authorities, or other institutions. Educere is not responsible for their independent decisions or rule changes.
To the maximum extent permitted by law, Educere is not liable for indirect or consequential loss that was not reasonably foreseeable when the agreement was made. Any contractual liability cap must not apply to fraud, deliberate misconduct, death or personal injury caused by negligence, violation of non-excludable consumer rights, unlawful data processing, or another liability that law does not allow to be limited. Because final entity and jurisdiction details require review, no fixed monetary cap is introduced in this operational draft.
22. Events outside reasonable control
Neither party is responsible for delay caused by events beyond reasonable control, such as major internet or utility failure, natural disaster, epidemic, civil emergency, government action, or sudden serious illness. The affected party should communicate promptly and take reasonable steps to reduce the impact.
For a tutoring session, Educere will normally reschedule or refund when such an event prevents delivery. For a course platform interruption, Educere may extend access or provide an alternative. A force-majeure event does not excuse payment for a service already delivered or remove a remedy required by law.
23. Updates to these Terms
Educere may update these Terms for changes in services, providers, law, safety practices, or business details. The page will show the effective and last-updated dates. Material changes affecting an existing paid service will be communicated through a reasonable channel before they take effect when required.
Changes apply prospectively. The terms shown when you purchased generally govern that purchase unless you agree to a change, the change benefits you without reducing rights, or law requires it. Continued use after clear notice may indicate acceptance for future use, but will not be treated as consent where law requires an express choice.
24. General provisions
If part of these Terms is unlawful or unenforceable, it will be limited or removed only to the extent necessary, and the remainder will continue. A delay in enforcing a term is not a waiver. You may not transfer your account or agreement without written permission. Educere may transfer the agreement as part of a legitimate reorganisation or business transfer if your rights are not materially reduced and required notice is given.
These Terms, the incorporated policies, the service description, and the confirmed checkout terms form the entire agreement about the purchased service. They replace earlier statements on the same subject but do not erase fraud, a written individual promise, or a right that cannot lawfully be excluded.
Headings help navigation and do not change meaning. Words such as including introduce examples and do not create an exhaustive list. Electronic acceptance and records may be used where legally valid.
25. Contact
Questions, complaints, accessibility requests, rights notices, and policy concerns should be submitted through the Educere Contact page. Include the account name, relevant service or booking, date, and a safe way to respond. Do not include full card numbers, passwords, government identification, or unnecessary information.
Educere will publish its verified legal entity name, business address, and dedicated legal contact after final confirmation. Until then, the Contact page is the official operational channel. If your matter concerns immediate danger, use the emergency or safeguarding service available in your location rather than waiting for a website response.
